AGENCY BOOKING CONDITIONS

All enquiries are made through our website and all bookings are made via telephone. Secure payment is taken at the time of booking.

When making your booking we will arrange for you to enter into a contract with The Machrie As agent we accept no responsibility for the acts or omissions of The Machrie or for the services provided by them.

Your booking via us is subject to these Agency Booking Conditions and the specific terms and conditions of The Machrie which you can access here and we advise you to read both carefully prior to booking. The Machrie’s booking conditions may limit and/or exclude their liability to you.

We are entitled, on behalf of The Machrie, to refuse any booking placed by you.

Full payment is required at the time of booking. Attempted bookings made without payment, or where payment fails, will be cancelled and you will not receive a confirmation booking email.

Credit Card payments are processed by us, acting as booking agent on behalf of The Machrie.

Except where The Machrie tells you or their booking conditions state otherwise, all monies you pay to us in respect of the booking will be held by us as agent on behalf of The Machrie and forwarded on to The Machrie in accordance with our agreement with The Machrie.

Subject to the availability and receipt of payment, you will receive an email to the email address given at the time of booking, confirming your payment.

Your booking is confirmed and a contract between you and The Machrie will exist when we send you confirmation of your booking.

The booking information that you provide to us will be passed on to The Machrie, therefore please check that all names, dates and timings are correct on the booking confirmation, and any other document and advise us of any errors immediately. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.

If you do not receive a booking confirmation within 24 hours of payment, please contact us immediately via email.

The booking information that you provide to us will be passed on only to The Machrie or other third parties necessary for the provision of the services.

You will need to take your booking confirmation with you to The Machrie as you may need to present this upon arrival to gain access.

If you have any special requests (for example dietary requirements), please let us know at the time of the booking. We will pass on all such requests to The Machrie, but we can’t guarantee that they will be met and we will have no liability to you if they are not. The fact that a special request has been noted on your confirmation email or any other documentation or that it has been passed on to The Machrie is not confirmation that the request will be met.

We strongly advise that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you (including due to adverse weather conditions, see below); the cost of assistance in the event of accident or illness; loss of baggage and money; and other expenses. Please check The Machrie’s booking conditions for further information.

The booking information that you provide to us will be passed on only to The Machrie or other third parties as necessary for the provision of the Package and your related arrangements. Please see our Privacy Policy for more information on your rights and how we process personal data.

Your personal information may be provided to public authorities as required by law.

Any special category (sensitive) information that you give to us such as details of any disabilities, dietary and / or religious requirements is provided with your explicit consent. In making your booking, you also consent to this information being passed on to the relevant third parties in relation to your booking.

Certain information may also be passed on to security or credit checking companies. If we cannot pass this information to The Machrie we may be unable to provide your booking.

All personal data processed by The Machrie will be processed under their own terms as a data controller in their own right. For more information on how The Machrie will process your personal information please view their privacy notices Privacy Policy.

We endeavour to ensure that all the information and prices both on our website and in any advertising material that we publish are accurate, however, occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the Package that you wish to book before you make your booking.

If you have to, or want to cancel or amend your booking, this request must be sent to us by email from the email address used to create the reservation. We will respond within two working days of receipt. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will always try to help, we cannot guarantee that any specific requests will be met. Amendments and cancellations can only be accepted in accordance with the booking conditions of The Machrie.

The amount we agree to refund you is dependent on how close your cancellation is to your arrival date. This is because we are less likely to recover the cost of your booking by re-selling the accommodation. The amount of any refund due therefore decreases as your arrival date approaches:

1. Notice of cancellation received 60 days (75 days for bookings of 3+ rooms) or more before arrival date: refund in full.
2. Notice of cancellation received 30 days (45 days for bookings of 3+ rooms) or more before arrival date: 50% refund in full.
3. Notice of cancellation received less than 30 days (45 days for bookings of 3+ rooms) before your arrival date: no refund.

If adverse weather conditions prevent you from reaching The Machrie, taking, or finishing your stay you are still subject to these cancellation terms. We strongly recommend that you take out a travel insurance policy which covers this eventuality.

We will inform you as soon as reasonably possible if The Machrie needs to make a significant change to your booking or to cancel it.

The Machrie has the right to cancel the booking due to the unavailability of key personnel. Third party providers or key facilities without which we cannot provide the accommodation or any aspects of the Package, including in circumstances outside of The Machrie’s control (such as due to fire, flooding or adverse weather). If this happens:

1. we will promptly contact you to let you know;
2. The Machrie will arrange for your account to be credited to the value of the cancelled element of the Package for you to be able to spend on goods and services provided by The Machrie. In the event that you do not use this credit during your stay, you will receive a refund from The Machrie upon your departure from The Machrie;
3. The Machrie may cancel your booking entirely and refund your payments, or offer alternative accommodation and refund any payments for accommodation not yet provided to you less the cost of alternative accommodation; and
4. if The Machrie offers alternative accommodation you may still choose to cancel the booking, The Machrie will refund the payments you have made via us.
5. any alternate accommodation, or refund made will not exceed the value of payment, and no compensation or expenses will be paid in such an event. We strongly recommend that you take out a travel insurance policy which covers this eventuality.

The Machrie may cancel your booking at any time with immediate effect if:

1. you do not pay us when you are supposed to, or
2. you are in breach of The Machrie’s terms and conditions in any other material way and where the breach is capable of remedy by you, you do not remedy the situation within a reasonable period after they ask you to.
3. If you do not arrive on the day in which your booking commences, or you have not notified us of a later arrival, we will cancel the booking and you will not be entitled to a refund.

As your contract is with The Machrie and we act as agent only, we accept no responsibility should you or a member of your party suffer injury or loss of possessions (through theft or accidentally) whilst staying at The Machrie or in respect of your Package.

If you or any member of your party has any medical condition or disability which may affect your stay, please provide us with full details before we confirm your booking and we will pass them on to The Machrie.

Acting reasonably, if The Machrie is unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking on The Machrie’s behalf or, if you did not give us full details at the time of booking, we will inform The Machrie who may cancel the booking and may impose applicable cancellation charges, when we become aware of these details.

Should you have a problem or complaint about the booking service that we provide, you must raise this at the time with us, via email [email protected]. This will enable most complaints to be handled in the shortest time possible. We are unable to respond to complaints about The Machrie, the Package or connected services.

Should you have any queries or concerns about The Machrie, the Package and/or their services, this should be addressed to The Machrie. If you have a problem during your stay at The Machrie, this must be reported to The Machrie immediately.

If you wish to complain when you return home, please contact The Machrie, you will see their contact details in the confirmation we send you.

If you remain unsatisfied, you can inform us, via email [email protected] as soon as possible and, in any event, within 28 days of the date of your stay at The Machrie whereby we will endeavour to assist in our capacity as an agent by liaising with The Machrie on your behalf.

All descriptions and content on our website or otherwise issued by us is done so on behalf of The Machrie and are intended to present an overview of the services provided by The Machrie. All services shown are subject to availability. If you require any further details, in respect of the Package or any other services please contact us.

Our only contractual obligation to you is to take your booking in accordance with your instructions and provide you with a confirmation email in respect of your stay at The Machrie. As agent, we accept no responsibility for your stay, Package or other services at The Machrie. Our responsibilities are limited to making the booking in accordance with your instructions.

We accept no responsibility for any information about The Machrie or any Package that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.

You are expected to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of others. If in the opinion of The Machrie or in the opinion of any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other guests or any third party, or damage to property, or to cause a delay or diversion to transportation, The Machrie reserves the right to terminate your booking immediately with no further liability to you. You and/or your party may also be required to pay for loss and/or damage caused by your actions and you and each member of your party will be jointly and individually liable for any damage or losses caused. Full payment for any such damage or losses must be paid directly to The Machrie prior to departure.

These Agency Booking Conditions are governed by English law and are subject to the jurisdiction of the English courts.
